Elon Musk has been ordered to appear in a New York City court amid a contentious legal battle with Ashley St. Clair over custody of their 5-month-old child.

The lawsuit, filed by St. Clair, who is 26, seeks sole custody of their son, who is identified only by his initials, R.S.C. Musk, 53, will be required to present his case on May 29, 2025, at the New York County Courthouse, where Judge Jeffrey H. Pearlman will review whether Musk should undergo a paternity test and whether St. Clair should be granted full custody of their child.

The court will also address the question of whether Musk should be ordered to pay child support.

In the court documents, St. Clair’s attorneys claim that Musk has yet to officially respond to the filing, either in person or through his legal representatives.

“Despite repeated requests, Mr. Musk has not accepted service of the motion papers,” said Karen B. Rosenthal, St. Clair’s attorney. “This delay is causing unnecessary distress and prolonging the litigation process.”

The legal team representing St. Clair has also highlighted that no attorney has yet claimed representation of Musk in the case.

The case raises questions about jurisdiction, as St. Clair resides in New York, and the child is said to be domiciled there. The filing indicates that Musk already has attorneys in New York, a factor that could influence the court’s decision regarding jurisdiction.

“We are working to avoid serving him at highly sensitive locations, such as the White House,” one of St. Clair’s attorneys noted in the filings.

This legal clash comes after St. Clair’s February 21 petition for sole custody of R.S.C., who was born in September 2024. In the petition, St. Clair alleges that Musk has not been involved in their son’s life, stating that he was not present for the birth and has met R.S.C. only three times.

The last of these meetings occurred on November 30, 2024, when Musk reportedly spent just 30 minutes with the child.

St. Clair claims that although Musk initially acknowledged the parentage of their child in written correspondence, including a text message exchange shortly after the birth, he has shown little interest in taking an active role in raising the child.

She provided evidence of a text message exchange in which she sent Musk a picture of their newborn, to which Musk allegedly replied, “I look forward to seeing you and him this weekend.”

However, after a brief meeting on September 21, 2024, and a subsequent shorter visit the following day, Musk’s involvement appeared to dissipate.

In her filing, St. Clair expressed her frustration with Musk’s lack of communication and participation, particularly regarding their child’s upbringing. “He can’t even be counted on to communicate, let alone be a father,” St. Clair said in a statement.

She further emphasized that she had intended to protect the privacy of their child by not revealing Musk’s identity earlier but now felt compelled to address the situation publicly.

On February 14, 2025, St. Clair took to social media to announce the birth of their child, revealing that Musk is the father of her 13th child. In her post, she expressed her desire to provide a stable and private life for their son.

“I intend to allow our child to grow in a normal and safe environment,” she wrote. “For that reason, I ask that the media honor our child’s privacy and refrain from invasive reporting.”
