Kevin Costner’s estranged wife is not allowed to remove specific items from the house, judge rules

The Yellowstone actor’s wife isn’t allowed to take any pots or pans from the house because Costner says there’s ‘no community property’.

A judge has ruled that Kevin Costner’s estranged wife must not remove specific items from the house they once shared.

The 68-year-old actor filed a new divorce order to prevent Christine Baumgarter, 49, from removing items from his $145 million estate.

After 18 years of marriage, Baumgartner filed for divorce in May 2023. The pair also share three children.

At the time, a statement on behalf of Costner read: “It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr. Costner having to participate in a dissolution of marriage action.”.

Costner owns the home they shared a home in Carpinteria, California, and Baumgartner is now moving into a new place.

The Yellowstone actor argued in his application ‘there is no community property’.

In June, he asked a judge to force Baumgartner to move out of their marital home – citing a clause in their pre-nup that gave her 30 days to move out after proceedings began.

A judge recently ruled that the actor’s wife must move out of the family home by 31 July.

On Friday 14 July, the judge did give the ruling obtained by Fox News Digital: “Christine shall be permitted to remove her toiletries, clothing, handbags and jewelry from Kevin’s Beach Club Road residence.”

Neither Baumgartner nor Costner actually attended court for this.

And Costner’s counsel, Jacqueline Misho stressed that the actor’s team just wanted confirmation the wife ‘would not remove items that were not agreed upon’.

And the judge did add in the ruling: “Christine is prohibited from removing any other items from the property, including, but not limited to furniture, furnishings, appliances and artwork from the Beach Club Road residences and from any storage unit maintained by the parties, whether jointly or individually absent a written agreement executed or by the parties or further court order.”.

Costner’s petition says that as Baumgartner has $1.5million at her disposal in all of this, it’s ‘plenty of money to buy furniture, pots and pans and dishes.’.

The judge wants all this property chat resolved before they go to trial over the enforceability and validity of the pre-nuptial agreement in November.

Earlier this month, a judge ordered Costner to pay almost $130,000 per month in child support payments. This is half of what Baumgartner went after to maintain the lifestyle their kids were used to.

Celebrity divorce lawyer, Christopher C. Melcher, previously told Fox News Digital: “Kevin feels like Christine wants to remove his separate property — furniture, computers, and equipment — from the home, which is not theirs to split.

This needs to be an orderly process. The items can be inventoried and remain in place for later determination.”.
