Trump’s $500 Million Fraud Penalty Overturned: A Legal Victory or Political Circus?

The appeals court, however, has now dismissed this financial penalty, leaving open the possibility for further appeals to the state’s highest court.
Judges Dianne T.Renwick and Peter H.Moulton, in their opinion, stated that while the court’s injunctive relief was appropriate to address the defendants’ business practices, the disgorgement order directing Trump to pay nearly half a billion dollars violated the Eighth Amendment of the United States Constitution, which prohibits excessive fines.
