Elberth León, Chief of the Tourist Police of Costa Rica’s Atlantic Region, insists he witnessed Warner’s heroic final act. Speaking publicly, León said, “I know what I saw when I arrived at the scene.

He was trying to save his daughter.” According to him, the child had been in the water, and the Red Cross tended to her on site—though she did not require hospitalization.

But the story is far from settled. Costa Rica’s Subdelegation of Bribri of the Judicial Investigation Agency (OIJ), the primary body overseeing the case, directly challenged León’s version.

In a carefully worded statement, the agency explained that Warner was initially playing with his daughter near the shoreline at Playa Cocles in Limón, located on the Caribbean coast.

However, investigators said Warner had later left his daughter out of the water and entered the sea again—this time with a friend. It was during this second swim that the fatal current struck.

“It appears that at one point, Mr. Warner was playing with his daughter at the shoreline,” said the OIJ.

“He later left her out of the water and supposedly entered the sea along with a friend. It was at that moment that the current pulled them in; the friend managed to get out, but unfortunately, Mr. Warner did not.”

This official timeline contradicts the claim that Warner’s death resulted from a direct attempt to rescue his child. León, undeterred by the dispute, responded with frustration, saying, “They interviewed Malcolm’s family, but they also weren’t there at the time of the accident.”

Further complicating the situation, a 29-year-old Nicaraguan man was also caught in the current while attempting to help Warner. He was successfully pulled from the water and hospitalized.

According to Costa Rica’s Red Cross, the man had been swept away while trying to reach Warner during the emergency. His identity has not been publicly released.

Warner, who rose to fame in 1984 as the charming, slightly rebellious Theo Huxtable on *The Cosby Show*, was widely admired not only for his acting but also for his career as a poet, director, and Grammy-winning musician.
